GetBy Travel Kit Terms, Conditions, and Disclaimers

Please read and understand these terms, conditions, and disclaimers prior to downloading or using the app. By downloading or using the app, these terms will automatically apply to you. You are not allowed to copy or modify GetBy, LLC’s trademarks, the app, or any portion of it, in any way. You are not allowed to attempt to extract the source code of the app. You are not permitted to translate the app into other languages or to make derivative versions. The app itself, each of the trademarks, copyrights, database rights, and all other intellectual property contained in or otherwise related to the app belong to GetBy, LLC.

GetBy, LLC is committed to ensuring that the app is as useful and efficient as possible. For this reason, we reserve the right to make changes to the app or to charge for its use, at any time, for any reason. However, we will never charge you for the app, its services, or its use without giving you adequate notice of charges that will apply and an opportunity to proceed or terminate use in advance.

GetBy, LLC’s app stores and processes data that you have provided to us in order to enable our provision of the app’s service to you. It is your responsibility to maintain the security of your phone or other device and your access to the app. We recommend that you do not remove software restrictions and limitations imposed by the phone’s or other device’s operating system. Doing so may make your phone or other device vulnerable to malware, viruses, malicious programs, or otherwise compromise your phone’s or other device’s security features. Doing so could mean that the GetBy, LLC app will not function or work properly in whole or in part.

Certain functions of the app require that your phone or other device have an active and continuous internet connection. GetBy, LLC is not responsible for: (i) your access to “wi-fi,” (ii) service provided by your mobile network provider, or (iii) any other act, omission, cause, or effect that impedes, interrupts or otherwise cancels your access to “wi-fi” or other mobile internet connectivity.

If you attempt to use the app or otherwise connect to it outside of an area where you have free internet access, the terms of your agreement with your mobile network provider will apply, and you may be charged for the cost of the data and/or the duration of time spent connected to the app. By connecting to the app, you accept responsibility for any charges, including roaming charges, that apply during the entire duration of your connection. Each app user is assumed to have express or other sufficient permission from the phone or other device subscriber to the mobile network provider. GetBy, LLC shall not be responsible for any charges or fees imposed upon a user or subscriber to a mobile network provider by such provider under any circumstances.

The app is designed to rely upon third parties to provide information to us so that we can make the app available to you. GetBy, LLC disclaims and accepts no responsibility for the functionality of such third- party providers’ services or software, the non-performance of which may negatively impact your use or ability to use the app. Despite the foregoing, GetBy, LLC strives to ensure that the app and its features are updated and operating correctly at all times.

The app may require updating periodically, and you will be required to download the updates in order to continue to using the app. GetBy, LLC currently supports the app’s use on a wide variety of platforms, including Android and iOS, but GetBy, LLC reserves the right to discontinue availability on one or more platforms at any time, without notice. GetBy, LLC reserves the right to stop providing the app in whole or in part and may terminate a portion or all of it at any time, without notice. Upon termination of the app by us, you acknowledge that the use license granted to you will also end, requiring you to discontinue use. If requested by us, you agree to delete the app from your phone or other device.

The app and the GetBy, LLC website are intended for general information purposes only. The information in the app is not intended to be a substitute for professional advice, the application and use of common sense, or acting lawfully under all circumstances, at all times.
